Terms & Conditions
1. Scope of Application
The General Terms and Conditions (hereinafter referred to as "GTC") apply to all orders placed and contracts concluded via the Fresco Studio online shop (hereinafter referred to as "online shop").
The online shop reserves the right to change the GTCs. The version of the GTCs valid at the time of the order applies, which cannot be unilaterally changed for that order.
2. Offer
The offer is aimed at customers residing in Switzerland. Deliveries are only made to addresses in this country.
The offer is valid as long as it is visible in the online shop and/or stock lasts. Price and assortment changes are possible at any time. The images shown in advertising, brochures, the online shop, etc., are for illustration purposes and are non-binding.
3. Order
The presentation of products in the online shop is not a legally binding offer, but a non-binding online catalog or a non-binding invitation to the customer to order the product and/or service in the online shop.
An order is considered an offer to the online shop to conclude a contract.
After transmitting the order, the customer automatically receives a confirmation of receipt, documenting that the online shop has received the order. After receiving this confirmation, the customer cannot change the orders anymore and is bound by them.
The online shop is free to fully or partially reject orders without stating reasons. In this case, the customer will be informed, and any payments already made will be refunded. Further claims are excluded. Products that are temporarily unavailable cannot be pre-ordered.
4. Conclusion of Contract
A contract is only concluded by the dispatch of the ordered products. As soon as the order is dispatched, this will be communicated to the customer via email.
However, if the contract item is a custom-made or special order, the contract is concluded with the written acceptance of the order by the online shop.
5. Price
Prices are stated in Swiss Francs, inclusive of VAT (value-added tax) and, if applicable, inclusive of the advance recycling fee ("vRG").
The decisive price is the one in the online shop at the time of the order.
Ordered chargeable additional services such as delivery, assembly, etc., are listed separately in the shopping cart and on the invoice.
6. Payment Options
Payments must be made in Swiss Francs.
Accepted payment methods include credit cards (Visa, Mastercard, American Express), TWINT, and PayPal. The charge is made directly after the order is placed.
7. Home Delivery
All orders of or over CHF 60.– are delivered free of charge. For orders under CHF 60.–, the delivery charge is CHF 4.90. The home delivery does not include any additional services such as unpacking and assembling the purchased item, taking back the packaging material, etc.
If products are delivered with obvious damage to the packaging or content, the customer must, irrespective of their warranty rights, immediately report these to the service provider (e.g., carrier, post) and refuse acceptance. The customer is obliged to obtain a damage confirmation report from the service provider (e.g., carrier, post). All transport damages must also be reported to the online shop immediately.
8. Delivery Date
The delivery time of 2-3 business days indicated in the online shop is non-binding. It starts from the shipping confirmation.
In case of (partial) impossibility of delivery, the respective order will be canceled, the customer informed, and any payments already made will be refunded.
If the online shop cannot meet the provisional delivery date, the customer is entitled to cancel his order in writing. The cancellation is valid if it arrives in writing at the online shop after the expiry of the delivery date and before the dispatch of the order. If the shipment of the order coincides with the cancellation letter from the customer, the customer can make use of his right of return according to number 9. If he fails to do so, the contract is considered to have been concluded.
Further claims arising from delivery delays or (partial) non-delivery are excluded.
There is no right to cancellation in the case of a delivery delay for custom-made and special orders.
9. Right of Return
A return is possible within 14 calendar days from the date of the postmark or the delivery or receipt confirmation. If the customer cannot provide the delivery or receipt confirmation, the 14-day period starts from the dispatch of the order.
The product must be returned in its original packaging, undamaged, clean, complete, and with any possible accessories. Any seal must not be broken.
- Custom-made and special orders
- Hygiene articles (e.g., shavers, epilators, toothbrushes, headphones)
- Consumables
If the customer returns the product in its original packaging, undamaged, clean, complete, along with any possible accessories and proof of purchase, the payment already made will be refunded, deducting any services already provided. An exchange is not possible.
10. Warranty
The warranty covers the defect-free condition and functionality of the product purchased by the customer for one year from the conclusion of the contract or the date of the postmark or the delivery or receipt confirmation.
The warranty does not cover normal wear and tear, the consequences of improper handling or damage by the customer or third parties, or defects that are due to external circumstances (e.g., normal reduction of battery performance, calcification, leaked batteries, modifications made to the product).
The online shop may choose to provide warranty service through free repair, equivalent replacement, or refund of the purchase price. Further claims are excluded.
11. Complaints
If products are delivered with obvious damage to the packaging or the content, the customer must, irrespective of their warranty rights, immediately report these to the service provider (e.g., carrier, post) and refuse acceptance. The customer is obliged to obtain a damage confirmation report from the service provider (e.g., carrier, post). All transport damages must additionally be reported to the online shop immediately.
Furthermore, it is the customer's responsibility to inspect the ordered products immediately upon receipt and report any defects or deviations from the order in writing to the online shop within 14 calendar days. Thereafter, only hidden defects can be claimed.
A defective product must be returned immediately. In such cases, the shipping costs will be borne by the online shop.
12. Data Protection
The online shop points out that the data collected during the conclusion of the contract is gathered, processed, and used to fulfill the obligations arising from the purchase contract. The necessary data for service provision and contract fulfillment may also be passed on to commissioned service partners (e.g., logistics companies, service partners, debt collection agency), also to countries that may not have an equivalent level of data protection. The customer agrees to this use of data by consenting to these GTCs.
13. Applicable Law and Jurisdiction
The legal relationship between the online shop and the customer is subject to substantive Swiss law, excluding conflict of laws provisions and the Vienna Sales Convention.
The place of jurisdiction for natural persons is Zurich or the customer's place of residence. For legal entities, the ordinary courts of the Canton of Zurich have exclusive jurisdiction.
